Tax laws change often. Burch & Cracchiolo knows it is imperative to track these changes to develop a strong tax strategy. Our tax attorneys have extensive experience handling both civil and criminal tax issues and can assist you with a variety of tax-related matters. Whether you are suffering the anxieties associated with an audit, or simply trying to formulate the ideal tax strategy for you and your organization, our attorneys will meet your needs on every level.
Tax Litigation. Our attorneys are well known for their expertise in representing taxpayers in civil and criminal tax litigation. Burch & Cracchiolo represents taxpayers in the United States Tax Court, United States District Court, United States Claims Court, the United States Supreme Court, the Arizona Superior Court, the Arizona Tax Court, and the federal and state appellate courts. Prior to entering private practice, the firm's tax attorneys represented the Internal Revenue Service in litigation with taxpayers.
Audits and Appeals. Burch & Cracchiolo attorneys resort to litigation only when it is in the client's best interest. Most civil tax disputes are settled at the audit or appeals office level. In audits and cases brought in the federal and state tax courts, strategies are pursued in order to maximize the chance of an early settlement, yet lay the groundwork for litigating the dispute if the case cannot be resolved at the administrative level.
Civil Tax. Our attorneys represent individuals, corporations, trusts and estates in civil tax litigation against the Internal Revenue Service in the United States Tax Court, United States District Courts and United States Courts of Appeal, as well as in litigation against the State of Arizona and Arizona Department of Revenue. Tax issues litigated have ranged from substantiation of business expenses, unreasonable compensation, defending pension plan deductions taken by plan sponsors, change of accounting methods and valuation issues through defending captive insurance relationships between related corporations, unreported income, and defending assumptions used by pension plan actuaries.
Criminal Tax. For more than twenty years, Burch & Cracchiolo attorneys have vigorously represented individuals and corporations who are targets of criminal tax and other types of financial investigations by the Internal Revenue Service, the Department of Justice and the Arizona Department of Revenue. The firm's tax attorneys represent clients in administrative investigations, grand jury investigations and trials in federal district court and the state's superior courts. They also represent clients in Internal Revenue Service and Department of Revenue civil audits which have the potential to be referred as criminal investigations.
Collection. Our attorneys regularly deal with Internal Revenue Service and Arizona Department of Revenue collection personnel. The firm's attorneys are accomplished in helping clients deal with liens, levies and seizures. The firm's attorneys negotiate installment agreements and offers in compromise, and, where appropriate, advise clients as to the discharge of taxes in bankruptcy.
State and Local Taxation. Burch & Cracchiolo attorneys provide a wide variety of services with respect to state and local taxes including the transaction privilege tax (sales and use taxes). The firm represents taxpayers in audits by the Arizona Department of Revenue and city taxing authorities.
